Equipment Use Agreement 

This Equipment Use Agreement outlines your responsibilities concerning all equipment, both assigned and unassigned, that is owned by The Samara Company, including but not limited to cell phones, laptops, vehicles, lawn mowers, tools, and any other equipment provided for use in the performance of your job. By accepting the use of this equipment, you assume temporary and exclusive responsibility for its preservation and agree to the following conditions: 

  1. Assigned and Unassigned Equipment 
    You acknowledge that you have been assigned certain equipment, as listed below, and may also use equipment that is not officially assigned to you. This includes but is not limited to cell phones, laptops, vehicles, lawn mowers, tools, and any other equipment necessary for job performance.

  2. Maintenance and Reporting of Damaged Equipment 

  3. You agree to maintain all equipment, whether assigned or not, in good and safe condition. If you find any equipment to be damaged, unsafe, or in disrepair, you are required to immediately report the condition to your supervisor and discontinue use until the equipment is repaired and restored to working order. This includes both assigned equipment and equipment that you are using temporarily. 

  4. Use of Equipment 
    You agree to use all equipment only as it is designed and intended for company business. You will ensure that equipment is used in a safe and responsible manner at all times. 

  5. Protection of Equipment 
    You agree to take reasonable precautions to protect the equipment from damage, theft, or unauthorized use. This includes securing equipment when not in use and immediately reporting any theft or loss of equipment to your supervisor. 

  6. Return of Equipment                                You agree to return all assigned equipment immediately upon request and in the same condition that it was issued to you, allowing for normal wear and tear. 

  7. Responsibility for Damage, Loss, or Negligence 
    In the event that any equipment assigned to you is lost, damaged, or destroyed due to intentional negligence or mishandling, you authorize the company to deduct the cost of repair or replacement from your paycheck. This includes, but is not limited to, damage caused by misuse, negligence, or failure to report issues promptly. 

  8. Reporting Requirement 
    It is your responsibility to promptly report any equipment that is damaged, broken, or in disrepair. Reporting issues in a timely manner helps ensure that the equipment can be repaired or replaced, ensuring its continued proper functioning and avoiding unnecessary costs for both you and the company. 

  9. Employees are responsible for the care and return of all company-issued equipment. Failure to return items upon separation or failure to properly maintain them may result in a payroll deduction to cover replacement costs. The following deduction amounts will apply:        Uniform – $30                                            Hard Hat – $20                                        Spikes – $20                                          Laptop – $1,000                                Phone – $900                                    Safety Vest – $20                             Winter Safety Coat/Set – $80

By signing this agreement, you acknowledge that you understand and agree to the terms outlined above, and that you will be held accountable for the proper use, care, and maintenance of all company equipment assigned to you or used in the course of your duties.
